The Jurisprudence of Constitutional Interpretation

The judicial function is all about interpretation. Judges and justices do not make law - that is the role of the legislature -- justices interpret existing law. Interpretation is an art, not a science. Sometimes, it's specific; other times, interpretation only yields more abstraction and obtuseness. Think of constitutional interpretation as trying to interpret the meaning of dreams.

Constitutional Law - An Overview

The broad topic of constitutional law deals with the interpretation and implementation of the United States Constitution. As the Constitution is the foundation of the United States, constitutional law deals with some of the fundamental relationships within our society. This includes relationships among the states, the states and the federal government, the three branches (The Executive, Legislature, Judiciary) of the federal government, and the rights of the individual in relation to both federal and state government

Constitutional Structure

The Constitution consists of seven (7) articles and 27 amendments. The most important articles are the first three which explain the powers of the three branches of government. Article I deals with the Legislative branch; Article II the Executive branch; and Article III, the Judicial branch. Other articles are also important for various doctrines and clauses. For the Amendments, it's customary to refer to the first ten as the Bill of Rights, however only the first eight (8) Amendments are truly substantive in terms of rights.
